This Privacy Policy describes how RVA Online Ventures LLC, doing business as SMSForms.io ("SMSForms," "we," "us," or "our"), collects, uses, discloses, and protects personal information in connection with our SMS-based lead capture services and platform (collectively, the "Services").

By using the Services or providing us with personal information, you acknowledge that you have read and understood this Privacy Policy and agree to its terms.

1. Scope of This Policy

This Privacy Policy applies to:

Business Customers: Companies and organizations that subscribe to SMSForms.io to collect leads and customer information via SMS.

Authorized Users: Employees, contractors, and other individuals authorized by our Business Customers to access and use the Services.

End Users/Consumers: Individuals who interact with our Business Customers by texting their SMSForms phone numbers or calling their forwarding numbers.

Website Visitors: Anyone who visits www.smsforms.io or related websites.

Our Role:

SMSForms.io operates in two capacities:

Data Controller: We act as a data controller when processing information about our Business Customers and Authorized Users (account information, billing, usage data, etc.).

Data Processor/Service Provider: We act as a data processor or service provider when processing End User/Consumer information on behalf of our Business Customers. In this capacity, our Business Customers are the data controllers and determine how their customers' information is used.

If you are an End User/Consumer whose information was collected through a Business Customer's use of SMSForms.io, that Business Customer's privacy policy governs how your information is used. Please contact them directly for questions about their privacy practices. However, this Privacy Policy still describes how we handle your information as a processor on their behalf.

2. Information We Collect

2.1 Information We Collect from Business Customers and Authorized Users

Account and Profile Information:

When you create an account or use the Services, we collect: business name and display name, owner first and last name, email address, phone numbers (emergency contact and business contact), business address and timezone, payment information (processed by our payment provider), service description and industry information, and selected trigger word for SMS conversations.

Usage Information:

We automatically collect information about how you use the Services: number of quotes/leads processed, number of voice minutes used, SMS messages sent and received, login history and access times, IP addresses and device information, browser type and operating system, and features accessed and actions taken within the platform.

Communications:

When you communicate with us, we collect: support ticket content and correspondence, phone call recordings with our support team (with notice), feedback and survey responses, and email communications.

2.2 Information We Collect from End Users/Consumers

When End Users interact with our Business Customers through SMSForms.io, we collect and process on behalf of our Business

Customers:

Contact Information: phone number (from which they text or call), name (as provided in SMS conversation), email address (as provided in SMS conversation), and physical address (as provided in SMS conversation).

Communication Content: text message content (all 6 questions and answers in the SMS conversation), call recordings (if Business Customer enables call recording), call duration, time, and date, and photos and videos sent via MMS.

Technical Information: phone carrier information, device type information (when available), message delivery status, and timestamps for all interactions.

Inferred Information: service interest (based on responses to our standardized questions), timeline preferences, and location information (based on provided address).

2.3 Information from Third Parties

We may receive information from: telecommunications providers (carrier information, number validation, call routing data), payment processors (payment confirmation, billing information), public sources (business information for verification purposes), Business

Customers (when they upload or import data to their SMSForms account), and affiliate partners (referral source information when you sign up through an affiliate link).

2.4 Information We Collect from Affiliate Partners

If you participate in our affiliate program, we collect: name and contact information, payment information (PayPal or bank account details for commission payments), referral tracking data (clicks, signups, conversions from your affiliate links), tax information (W-9 or equivalent for tax reporting), and performance metrics (number of referrals, commission earned, payment history).

2.4 Information Collected Automatically

Cookies and Similar Technologies:

We use cookies, pixels, and similar tracking technologies to: maintain your login session, remember your preferences, analyze website traffic and usage patterns, deliver targeted advertising, measure marketing campaign effectiveness, and track affiliate referrals (if you sign up through an affiliate link).

Third-Party Analytics and Advertising:

We use Google Analytics to understand website usage and improve user experience, and Facebook Pixel to measure and optimize marketing campaigns on Facebook and Instagram.

These services may collect information about your visits to our website and other websites over time.

2.5 De-identified Information

We may create aggregated, de-identified, or anonymized data from the information we collect. This data does not identify you personally and may be used and shared freely for industry research, service improvement, marketing purposes, and benchmarking.

3. How We Use Your Information

3.1 For Business Customers and Authorized Users

Provide and Maintain Services:

We use your information to: create and manage your account, process payments and billing, provision phone numbers and configure Services, deliver SMS and voice services, store and organize lead information, provide customer support, send service notifications and important account updates, and track affiliate referrals and calculate commissions (if applicable).

Improve and Develop Services:

We use your information to: analyze usage patterns to enhance features, develop new products and services, conduct research and testing, identify and fix technical issues, and optimize system performance.

Marketing and Communications:

We use your information to: send promotional emails about new features (with opt-out option), display targeted advertisements on social media and other platforms, conduct surveys and request feedback, and share product updates and best practices.

Legal and Compliance:

We use your information to: comply with legal obligations and regulatory requirements, enforce our Terms of Service and other policies, prevent fraud, spam, and abuse, protect our rights and property, and respond to legal requests from authorities.

3.2 For End Users/Consumers (Processing on Behalf of Business Customers)

We process End User information on behalf of our Business Customers for the following purposes:

Conversation Management: facilitate SMS conversations between Business Customers and their customers, store conversation history and lead information, organize and present lead data to Business Customers, and route phone calls to Business Customer forwarding numbers.

Service Delivery: send automated SMS messages as part of the 6-question conversation flow, deliver SMS and email notifications to Business Customers about new leads, store and serve photos/videos uploaded by End Users, and track conversation completion status.

Quality and Security: detect and prevent spam abuse, block numbers that send excessive unrecognizable messages, monitor for violations of acceptable use policies, and maintain service reliability and performance.

Legal Basis for Processing (for EU/UK Data Subjects):

When we process personal data as a controller, we rely on the following legal bases: contract performance (processing necessary to provide Services you've requested), legitimate interests (improving our Services, preventing fraud, marketing where permitted), legal obligations (complying with applicable laws and regulations), and consent (where we've obtained your specific consent, such as for marketing emails).

4. How We Share Your Information

4.1 Service Providers and Subprocessors

We share information with trusted third-party service providers who perform services on our behalf, including:

Infrastructure and Hosting Providers: database hosting and management, application hosting and content delivery, and cloud infrastructure services.

Communications Service Providers: SMS message delivery and routing, voice call routing and connectivity, phone number provisioning and management, and telecommunications infrastructure.

Payment Processing Services: payment processing and transaction management, subscription billing and management, and fraud detection and prevention.

Email Service Providers: transactional email delivery and notification email services.

Analytics and Performance Services: website analytics and usage tracking, caching and performance optimization, advertising measurement and campaign tracking, and affiliate referral tracking and commission management.

These service providers are contractually obligated to use your information only as necessary to provide their services to us and to protect your information appropriately.

4.2 Affiliate Partners

If you sign up through an affiliate partner's referral link:

We share limited information with the affiliate partner: confirmation that their referral resulted in a signup, subscription status (active, cancelled, refunded), and commission eligibility (after 31-day pending period).

We do not share: your contact information, payment details, usage data, or any customer/lead information with affiliate partners.

Affiliates receive: aggregate performance metrics (number of referrals, active subscriptions, commission amounts) without access to individual customer identities or details.

4.3 Telecommunications Service Providers

For SMS and voice services to function, we must share certain information with mobile carriers and telecommunications operators (to route messages and calls to their intended recipients) and intermediary providers (for message delivery and call connectivity).

These providers handle this information as required to deliver communications and may be subject to their own privacy policies and local telecommunications regulations.

4.4 Business Customers

If you are an End User/Consumer, we share your information with the Business Customer you interacted with. The Business Customer receives: all information you provide during the SMS conversation (name, email, address, service details, timeline, etc.), photos and videos you upload, your phone number and contact information, and timestamps and conversation metadata.

The Business Customer is responsible for how they use, store, and protect this information in accordance with their own privacy policy and applicable laws.

4.5 Legal Requirements and Protection

We may disclose information when required by law or when we believe in good faith that disclosure is necessary to:

Comply with legal obligations, court orders, subpoenas, or government requests, enforce our Terms of Service and other agreements, protect the rights, property, or safety of SMSForms, our customers, or the public, prevent fraud, security threats, or illegal activities, respond to claims of rights violations, and cooperate with law enforcement or regulatory investigations.

We will notify affected parties of legal requests for information unless prohibited by law or court order, or in emergency situations.

4.6 Business Transfers

If SMSForms is involved in a merger, acquisition, sale of assets, bankruptcy, or other business transaction, your information may be transferred as part of that transaction. We will notify you via email and/or prominent notice on our website of any change in ownership or use of your information, and any choices you may have regarding your information.

4.7 With Your Consent

We may share your information with other parties when you give us explicit consent to do so, such as: when you authorize integration with third-party CRM or business tools, when you participate in co-marketing activities, or when you request that we share information with specific parties.

4.8 Aggregated and De-Identified Data

We may create aggregated, de-identified, or anonymized data from the information we collect. This data does not identify you personally and may be used and shared freely for industry research and analysis, service improvement and development, marketing and promotional purposes, and benchmarking and statistics.

5. Cookies and Tracking Technologies

5.1 Types of Cookies We Use

Essential Cookies:

Required for the Services to function: authentication and session management, security and fraud prevention, and load balancing and performance.

Functional Cookies:

Enhance your experience: remember your preferences and settings, provide personalized features, and store information you've entered in forms.

Analytics Cookies:

Help us understand how users interact with our Services: Google Analytics (website traffic, user behavior, conversion tracking), page views, session duration, bounce rates, and feature usage and navigation patterns.

Advertising Cookies:

Enable targeted advertising and measure effectiveness: Facebook Pixel (conversion tracking, audience building, ad optimization), display relevant ads on Facebook and Instagram, measure ad campaign performance, and create lookalike audiences.

5.2 Your Cookie Choices

Browser Settings:

Most browsers allow you to: block all cookies, block third-party cookies only, delete cookies after each session, and receive notifications when cookies are set.

Do Not Track:

Some browsers have "Do Not Track" (DNT) features. Our website does not currently respond to DNT signals, but you can use the opt-out methods described above.

Note: Disabling cookies may limit your ability to use certain features of the Services.

6. Data Security

6.1 Security Measures

We implement appropriate technical and organizational measures to protect personal information, including:

Technical Safeguards: encryption of data in transit (TLS/SSL), encryption of sensitive data at rest, secure authentication and access controls, regular security assessments and penetration testing, automated security monitoring and alerting, and secure backup and disaster recovery procedures.

Organizational Safeguards: limited access to personal information (need-to-know basis), employee training on data protection and privacy, confidentiality agreements with employees and contractors, vendor security assessments and contracts, and incident response and breach notification procedures.

Infrastructure Security: secure cloud hosting with enterprise-grade providers, network security and firewalls, DDoS protection, and regular software updates and security patches.

6.2 Account Security

You are responsible for: maintaining the confidentiality of your login credentials, using strong, unique passwords, enabling multi-factor authentication (when available), and promptly notifying us of any unauthorized access or security breach.

6.3 Limitations

No security system is impenetrable. While we strive to protect your information, we cannot guarantee absolute security. We cannot ensure the security of information you transmit to us over the internet, and you do so at your own risk.

6.4 Security Incidents

In the event of a data breach that affects your personal information, we will: investigate the incident promptly, notify affected parties as required by applicable law, take steps to remediate the breach and prevent future incidents, and cooperate with law enforcement as appropriate.

7. Data Retention

7.1 Business Customer and Authorized User Data

We retain your information for as long as your account is active or as needed to provide Services. Retention periods include:

Active Accounts: account and profile information (duration of subscription plus 7 years), usage and analytics data (duration of subscription plus 7 years), billing and payment records (7 years for tax and accounting purposes), and support communications (3 years).

Deleted Accounts:

When you delete your account: (1) 30-Day Grace Period - account enters grace period; data remains accessible for reactivation, (2) After Grace Period - account and associated data are permanently deleted, except data required for legal, tax, or regulatory compliance (retained for 7 years), aggregated/de-identified data (retained indefinitely), and data necessary to resolve disputes or enforce agreements.

Early Deletion Requests:

You may request immediate deletion by emailing support@smsforms.io. We will honor such requests except where retention is required by law or necessary for legitimate business purposes (e.g., resolving disputes, preventing fraud).

7.2 End User/Consumer Data

For information collected on behalf of Business Customers: retention is determined by the Business Customer's instructions and policies, when a Business Customer deletes their account, associated End User data is deleted per the schedule above, and End Users may request deletion by contacting the Business Customer directly or emailing us at support@smsforms.io.

7.3 Automated Deletion

We have automated systems that: delete expired conversation data (36 hours after last activity if incomplete), purge accounts after grace period expiration, remove temporary files and cached data, and clean up orphaned records.

7.4 Backup Data

Information in backup systems may persist beyond the primary deletion date but is not actively used and will be permanently deleted once backups are rotated out (typically within 90 days).

8. Your Rights and Choices

8.1 Rights for Business Customers and Authorized Users

Access Your Information:

You can access most of your account information by logging into your SMSForms dashboard. You may also request a copy of your information by emailing support@smsforms.io.

Update or Correct Information:

You can update your profile information, business details, and preferences directly in your account settings. For assistance, contact support@smsforms.io.

Delete Your Account:

You can delete your account at any time through your dashboard settings or by contacting support@smsforms.io. Note that deletion is subject to our 30-day grace period and retention obligations described in Section 7.

Export Your Data:

You can export your lead data and conversation history from your dashboard. For a complete export of your account data, email support@smsforms.io. We will provide your data in a commonly used, machine-readable format within 7 business days.

Object to Processing:

You may object to certain types of processing, such as marketing communications (see below).

Marketing Opt-Out:

To stop receiving promotional emails: click the "unsubscribe" link in any marketing email, update your communication preferences in your account settings, or email support@smsforms.io with "Unsubscribe" in the subject line.

Note: You cannot opt out of transactional or account-related communications while you maintain an active account (e.g., billing statements, security alerts, Terms updates).

8.2 Rights for End Users/Consumers

If your information was collected through a Business Customer's use of SMSForms.io:

Primary Contact:

First contact the Business Customer who collected your information, as they control how your information is used.

Contact Us Directly:

You may also email us at support@smsforms.io to: request access to your information, request correction of inaccurate information, request deletion of your information, object to processing of your information, or request a copy of your information in portable format.

We will respond within 7 business days and coordinate with the applicable Business Customer as needed.

SMS Opt-Out:

To stop receiving SMS messages from a Business Customer using SMSForms.io, reply "STOP" to any message from their number. This will opt you out of further messages from that specific Business Customer.

8.3 Verification and Fees

For security purposes, we may need to verify your identity before responding to certain requests. We will typically do this by: confirming your email address, asking security questions about your account or interactions, or requesting additional identification documents (for sensitive requests).

We do not charge a fee for most requests, but we may charge a reasonable fee if: your request is clearly unfounded or excessive, you request multiple copies of the same information, or the request requires disproportionate effort to fulfill.

We will inform you of any fees before processing your request.

8.4 Response Time

We will respond to your requests: within 7 business days for most requests, within 30 days if the request is particularly complex or requires coordination with Business Customers, and we will notify you if we need additional time or cannot fulfill your request.

9. California Privacy Rights

9.1 CCPA Applicability

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with additional rights regarding your personal information. This section applies to "consumers" as defined by CCPA, which may include Business Customers in their individual capacity but not when acting on behalf of a business entity.

9.2 Categories of Information

In the preceding 12 months, we have collected the following categories of personal information:

Identifiers: name, email, phone number, IP address, account username

Customer Records: name, address, phone number, payment information

Commercial Information: purchase history, subscription details, usage records

Internet/Network Activity: browsing history, interactions with website, app usage

Geolocation Data: general location based on IP address or provided address

Audio/Visual Information: call recordings (if enabled), profile photos

Professional/Employment Information: business name, job title, industry

Inferences: preferences, characteristics, behavior derived from activity

9.3 Sources of Information

We collect personal information from: directly from you (account creation, profile updates, communications), automatically through your use of Services (usage data, device information), from Business Customers (when they use our Services to collect leads), from third parties (payment processors, telecommunications providers), and from publicly available sources (business verification).

9.4 Business Purposes for Collection and Use

We collect and use personal information for the business purposes described in Section 3, including: providing and maintaining Services, processing transactions, customer support and communications, service improvement and development, security and fraud prevention, legal compliance, and marketing and advertising (with opt-out rights).

9.5 Disclosure of Personal Information

In the preceding 12 months, we have disclosed personal information for business purposes to the following categories of third parties: service providers and subprocessors (as described in Section 4.1), telecommunications providers (for SMS/voice delivery), Business Customers (for End User/Consumer data), professional advisors (lawyers, accountants), and government entities (when legally required).

9.6 Sale or Sharing of Personal Information

We do not sell personal information. We do not exchange your information for monetary compensation.

Sharing for Targeted Advertising:

We share certain information (identifiers, internet activity) with advertising partners like Facebook to deliver targeted advertisements. Under CCPA, this may be considered "sharing" for cross-context behavioral advertising.

Categories Shared for Advertising: identifiers (email, hashed phone number, device IDs) and internet activity (website visits, page views, interactions).

Third Parties for Advertising: Facebook/Meta (via Facebook Pixel) and Google (via Google Analytics advertising features).

Opt-Out: You can opt out of this sharing at any time (see Section 9.8 below).

9.7 Your California Privacy Rights

California residents have the following rights:

Right to Know:

You have the right to request: categories of personal information we collect, use, and disclose, specific pieces of personal information we hold about you, business or commercial purpose for collecting your information, categories of sources from which we collected your information, and categories of third parties with whom we share your information.

Right to Delete:

You have the right to request deletion of your personal information, subject to certain exceptions (e.g., legal obligations, security purposes, completing transactions).

Right to Correct:

You have the right to request correction of inaccurate personal information.

Right to Opt-Out of Sale/Sharing:

You have the right to opt out of the "sale" or "sharing" of your personal information for targeted advertising purposes.

Right to Limit Use of Sensitive Personal Information:

We do not use or disclose sensitive personal information for purposes beyond those permitted under CCPA. Therefore, this right is not applicable to our Services.

Right to Non-Discrimination:

We will not discriminate against you for exercising any of your CCPA rights, including by: denying goods or services, charging different prices or rates, providing a different level or quality of service, or suggesting you will receive a different price or level of service.

Right to Appeal:

If we deny your request, you have the right to appeal our decision.

Verification:

To protect your privacy, we will verify your identity before fulfilling requests by: matching information you provide to information we have on file, sending verification emails to your registered email address, and requesting additional documentation for sensitive requests.

Response Time:

We will respond to verified requests within 30 days for initial CCPA requests. If we need more time (up to 45 days total), we will notify you of the extension and the reason.

9.9 California Shine the Light Law

California Civil Code Section 1798.83 permits California residents to request information about disclosure of personal information to third parties for direct marketing purposes. We do not share personal information with third parties for their direct marketing purposes.

10. Children's Privacy

Our Services are not directed to, and we do not knowingly collect information from, children under 13 years of age (or under 16 in some jurisdictions).

No Intentional Collection: We do not intentionally collect personal information from children. Our Services are designed for business use only.

Business Customers' Responsibility: Business Customers are responsible for ensuring they do not use our Services to collect information from children.

Parental Notification: If we learn that we have collected personal information from a child under 13 without parental consent, we will take steps to delete that information as quickly as possible.

How to Report: If you believe we have inadvertently collected information from a child, please contact us immediately at support@smsforms.io.

11. International Data Transfers

11.1 US-Based Services

Our Services are operated in the United States. If you are located outside the United States, please be aware that: your information will be transferred to, stored, and processed in the United States, US data protection laws may differ from those in your country, and by using our Services, you consent to the transfer of your information to the United States.

11.2 Geographic Restrictions

SMSForms.io currently only serves businesses located in the United States. We do not intentionally market to or collect information from individuals in other countries, particularly the European Union, United Kingdom, or Switzerland.

11.3 Data Transfer Safeguards

When we transfer personal information internationally, we implement appropriate safeguards, including: conducting transfers only to service providers who have agreed to protect personal information adequately, implementing standard contractual clauses where applicable, relying on adequacy decisions by relevant data protection authorities where available, and obtaining consent where required by applicable law.

11.4 EU/UK/Swiss Data Subjects

While we do not intentionally serve EU, UK, or Swiss residents, if your information is nonetheless processed by us:

Legal Bases: We process your information based on performance of a contract with you or your organization, compliance with legal obligations, legitimate interests (where not overridden by your rights), and your consent (where obtained).

Your Rights: You may have rights under GDPR or similar laws to access, correct, or delete your information, object to or restrict processing, data portability, withdraw consent, and lodge a complaint with your local data protection authority.

12. Third-Party Links and Services

12.1 Third-Party Websites

Our website and Services may contain links to third-party websites, applications, or services that are not operated by us. For example: links to resources, articles, or tools we reference, integration with third-party CRM or business tools, and social media platforms.

We are not responsible for: the privacy practices of these third parties, the content or functionality of external sites, or how these services collect, use, or protect your information.

Your responsibility: Review the privacy policies of any third-party sites you visit. Their practices may differ significantly from ours.

12.2 Third-Party Integrations

If you choose to integrate SMSForms.io with third-party services (e.g., your CRM): you authorize us to share specified information with those services, the third party's privacy policy and terms govern their use of your information, you are responsible for configuring integration settings appropriately, and we are not liable for how third parties use or protect your information.

12.3 Business Customer Websites

If you are an End User who provided information through a Business Customer's website with our SMS widget or forms, the Business Customer's privacy policy applies to information collection on their website. Our Privacy Policy applies only to our processing of that information as a service provider to the Business Customer.

13. Changes to This Privacy Policy

13.1 Updates and Revisions

We may update this Privacy Policy from time to time to reflect: changes in our information practices, changes in applicable law or regulations, new features or services we offer, feedback from users or privacy advocates, and industry best practices.

13.2 Notification of Changes

Material Changes:

If we make material changes that affect how we collect, use, or share your information, we will: post the updated Privacy Policy on our website with a new "Effective Date," notify you by email at least 30 days before changes take effect (for Business Customers), display a prominent notice on our website or dashboard, and request your affirmative consent if required by law.

Non-Material Changes:

For minor updates (e.g., clarifications, formatting, contact information updates), we will: post the updated Privacy Policy with a new "Effective Date" and not separately notify you of the changes.

13.3 Version History

We maintain a version history of our Privacy Policy. You can request previous versions by emailing support@smsforms.io.

13.4 Continued Use

Your continued use of the Services after the effective date of changes constitutes your acceptance of the updated Privacy Policy. If you do not agree to the changes, you must stop using the Services and may close your account.
